Asset Management & Recovery: How About A Quick $50, Honey? No? You’re Kidding?

I was at a closing tonight on a lender owned deal.  This was especially nice since it was one of the few where an owner/user was getting the property instead of another investor.

The buyer agent was extremely nice and extremely professional although she does not do a lot of lender deals and thought the process was extremely taxing. Cross the T and dot the I.  Not that big of a deal to me.

A term in the addendum was that if the property failed to close by Dec. 18, the buyer would pay an additional $100 a day until closed, but only if the delay was the fault of the buyer or buyers side.  As it happens, the buyers lender was late so the deal closed today.  Yep'er'doodles there was an extra $100 on the HUD.

 The buyer agent, of course, is wanting a refund.  I really, really, really need to be somewhere else, so I offer to cover the $100.  Let's move on, ok folks?  The buyer agent tells me that she can't let me do that because she will feel guilty.  There's nothing to feel guilty about, I tell her.  If it is a big deal and will make you feel better, whip out a $50.  Problem solved. 

That wouldn't be right, she says.

So here I am sitting in a closing with $100 between me and getting to my next appointment and the buyers agent will not allow me to write the check.

Ultimately, the buyers agent demands that the closer call the lender/seller and get the $100 waived.  Long story on why this was not my responsibility.  Trust me.

Longer story shorter, I email the lender/seller to tell her that the closing has been completed and ask if there are any more deals I can help with.  The response was that she will keep in mind both my request and the fact that I cost the bank an extra $100.

Please folks.  As a matter of good business and common courtesy, if the other side is willing to cough up the $$ to make the deal work either step up to the plate and help or stay out of the way.

OhhLaaLaa - Why oh why won't people just let us do our job. It would have been worth paying the money to keep the lender happy. If it doesn't bother us, why should it bother the other agent. Sometimes people just need to get out of the way.

Hi Rich, she should have just left well enough alone and let you pick up the tab. The she should have said "Next".

I agree she should have gotten out of the way.

I guess I don't understand why the Lender/Seller is blaming you for the $ 100.00? Am I missing something here?

Hi Rich, I've heard of a deal falling apart at the end becouse there was some small repairs needed to be completed in order for the buyers to sign off. The seller refused,the buyer refused, and both agents refused, to pony up the costs, deal fell apart, cost would have been under $300. Around a $400,000 deal shot down the tubes. Can't belive agents let $12,000 each go over $300. Wouldn't have been me. Glad yours closed, even though you got the black eye.

There's those damn principles getting in the way of common sense and getting a deal closed again. I guess some agents just don't get it. Close it and move on. Heck it would cost me $100 worth of my time just to make the call.

Jay - It was not the money, rather that the lender/seller needed to take time out of managing the other 899 files on her desk to deal with this $100 problem.  She was annoyed.  I knew that was going to happen.

I'm glad to see that the supply of morons that work in the business dosen't seem to be drying up!

If you were going to cover the $100 the buyers Agent should have said 'Thanks', period, done.

who cares about feelings, who cares if she felt guilty plays ...  she should have said "thank you"

At what point did moral fortitude and common sense part ways?  We used to try and do the 'right things right' but this sounds so much like a great example of the 'right thing wrong' on the buyer's agent's part.

Boy...  I can't say for certain, but I swear it's against federal law to have duplicates of fifty-dollar bills like this.  Better be careful with the morons that we have running the show right now.  They'll lock you up and throw away the key.

The parking garage at the courthouse doesn't take $50's.  Since I essentially live and breath here, there is no other reason to have a $50.
